Course Description: This course focuses on competition law and policies in an international context. It provides a detailed analyses of the basic concepts of competition law. The the course focuses on: i) how competition law works in different regions of the world, such as the United States of America, Europe, or in developing countries; ii) the involvement and role of international organizations in avoiding unfair competition; iii) as well as on the types and ways of cooperation of the states within the framework of the proper functioning of the markets. The course analyses as well the enforcement of competition rules in different sectors including in the digital market.

Të njohë studentin me aktet normative të Republikes se Shqiperise, Bashkimit Europian dhe SHBAse dhe dispozitat përkatëse të tyre, të cilat përbëjnë bazen ligjore dhe kuadrin rregullator të së drejtës së konkurrencës 3. Të japë një informacion të plotë mbi aspektin procedural dhe institucional që ekziston në fushën e konkurrencës vecanerisht duke u fokusuar ne tre juridiksione 4. Të ndihmojë studentin të vlerësojë rëndësinë që respektimi I konkurrencës së ndershme ka në mirëfunksionimin e tregut 5. Të ndërthurë anën teorike në kuadër të së drejtës së konkurrencës, me mënyrën si ajo gjen aplikim në praktikë, duke u ndalur në studimin e rasteve më tipike ku ka gjetur implikim kjo e drejtë.

COURSE OUTLINE
Week Topics
1 Introduction to competition law and refining some concepts ideas Competition law has grown at a phenomenal rate in the past 30 years in response to the enormous changes in political thinking and economic behaviour that have taken place around the world. There are now more than 130 systems of competition law in the world. This class introduces the importance of competition law nowadays and refining basic concepts ideas.(Whish & Bailey 2021, chapter 1; Dabbah 2012, chapter 1)
2 The involvement of international bodies and organisations in the field of competition law and policy The internationalisation of competition law is a topic that has received considerable attention particularly in recent years. Most of this attention has emerged within the academic arena; though one must not overlook the important work of certain international organisations and competition authorities which have contributed significantly towards enhancing this attention. This week will look to the majority of initiatives have proposed furthering the internationalisation of competition law through existing international organisations such as the World Trade Organisation (WTO), the Organisation for Economic Cooperation and Development (OECD), the United Nations Conference on Trade and Development (UNCTAD) and the International Competition Network (ICN). 3 EU competition law regime This chapter will consider the competition law regime of the European Union (EU)..Beyond serving as a global ‘model’, the EU competition law regime has served as a valuable source, which many competition authorities frequently use for insights into how competition issues are analysed and to learn about recent trends and developments in the field. (Dabbah 2012, chapter 4)
4 US competition law regime The US competition law regime is one of the oldest and most influential regimes in the world. Many people consider that the first legislation in the field of competition law enacted in ‘modern times’ was the US Sherman Act, the first federal competition law adopted in 1890. This week sheds light into US competition law. (Dabbah 2012, chapter 5)
5 Albanian competition law regime This week will focus on the Albanian competition law regime. The lecture will provide a historical overview of the development of Competition law in Albania and then will be focus on substantive and procedurial aspect. In the end, will be discussed public and private enforcement. (Skara 2022, chapter 5)
6 Competition law and policy in developing countries The phenomenal geographical expansion of competition law in recent years has been most noticeable in the developing world. This expansion has occurred against the backdrop of the economic transformation witnessed worldwide and which has led to an increased reliance on the market mechanism. The impact of this shift has been particularly felt in developing countries, many of which have been taking remarkable steps in replacing their centrally planned economies with ones based on free-market philosophy. This week will analyse some examples of competition provision in the developing countries. (Dabbah 2012, chapter 6)
7 Regional (WBc) competition law and policy This chapter offers a regional overview of competition law and policy as they have come to be developed of the WBc different. The aim here is to analyse and compare competition law.
8 The bilateral option: cooperation between competition authorities The focus of this class will be on bilateral cooperation between competition authorities: what can be termed the bilateral option. The mechanism of bilateral cooperation can be considered to be an old one in the field of competition law and a considerable amount of literature has been written on the topic. Among other things, the chapter will consider the different types of bilateral cooperation and their use in actual cases. (Dabbah 2012, chapter 9)

10 The multilateral option: cooperation through binding and non-binding commitments The focus in this class will be on specific forms which this option can take and which may be conveniently grouped together under two headings: ‘binding’ obligations and ‘non-binding’ obligations. 11 The EU, US and Albania method of antitrust enforcement: private and public enforcement This week will focus on the modes of enforcement of antitrust competition. During the lecturer will be made comparison between 3 jurisdictions: the EU, US and Albania. (Skara 2022, Chapter 3
12 New technologies and Competition Digital platforms are essential elements of today’s economy, in particular since the outbreak of the coronavirus disease of 2019 (COVID-19) pandemic, and are a key issue for Governments and competition authorities worldwide. During the lessons, students will be introduced with the concept of new technologies and then discussed the impact on competition law. 13 Algorithm-driven collusive conduct This week examines the effects of algorithm-driven horizontal and vertical anticompetitive collusive conduct through the lens of competition law in a number of jurisdictions. It discuss that existing antitrust law is able to address some conduct, but that other forms of restraint which are algorithmically driven and facilitated by platform business models may require a change in competition law. The lecture analyses current application of competition law in a number of jurisdictions and provides recommendations as to the form of changes required. (Healey et al 2022, chapter 7)
14 AI and competition: EU and US Approach Artificial intelligence is a rapidly advancing field that policymakers everywhere are struggling to keep up with. Close cooperation between Europe and the US is not a given: Europe sees the US as its main competitor in AI; the US wants to join forces against China on AI, but European interest in such a front is weak. This week will be focus on the AI and Competition law. It will analyse the approach taken by the EU and US. (Franke 2021)
