Course Description: Lënda ka për qëllim t’u japë informacion studentëve mbi çështjet ligjore dhe të politikave që lidhen me internetin. Lënda do të trajtojë një gamë të plotë të temave ligjore, ajo përfshin diskutimin e juridiksionit, pronësisë intelektuale, kontrata, taksimin, detyrimet, krimet kompjuterike, fjalim në internet, shpifjen dhe privatësinë. Lënda përfshin cësthje të kohëve të fundit relevante duke mbuluar zhvillimet të fundit në cyberlaë-nga t cilat rregullohen nga legjislacioni ndërkombëtar dhe ai kombëtar.
Course Objectives: Lawyers currently use a variety of technologies to stay up-to-date and effective. Many lawyers use electronic databases to research cases and statutes. Lawyers also use technology to document and communicate with clients. Technology is so important that many courts require lawyers to use electronic documents whenever possible. The objective of this course is to show the importance of technology in the lawyer experience and discuss the relationship between Law and Technology.

COURSE OUTLINE
Week Topics
1 Week 1: Regulating the Information Society This week provides a historical overview of the development of the internet and discusses the importance of legal regulations. Particularly, the US and EU approaches to regulating the internet will be analysed. (Murray 2023, chapter 4)
2 Week 2: Cyber-speech This week examines cyber-speech and its implications for free expression. Firstly, it provides an overview of the technologies involved such as web pages, blogs, and social media platforms. Then, the lesson will focus on the discussion of the restriction of freedom of speech in the digital era. (Murray 2023, chapter 5)
3 Week 3: Social networking and antisocial conduct This week examines antisocial conduct in social media platforms (SMPs) focusing on Facebook, TikTok and Twitter. Firstly, an overview of how social networking breeds gossip and speculation, leading to invasion of privacy, will be discussed. Also, the lesson will analyse the use of social networks in cyberbullying, trolling, harassment, and criminal threats and discuss legislative initiatives. (Murray 2023, chapter 6)
4 Week 4: Defamation This week discuss defamation cases arising from traditional media sites and user-generated media entries. It first provides an overview of the tort of defamation, and the issue of who is responsible and potentially liable for an online defamatory statement. The class will refer to the EU legislation and well-known cases. (Murray 2023, chapter 7)
5 Week 5: Digital creativity and copyright law This week discuss intellectual property rights (IPRs) in relation to the information society. It begins with an overview of IPRs involving copyright, patents, trademarks, and database rights, and then considers IPRs and the process of digitisation within the framework of cyberlaw. The lesson will then be focused on certain issues such as free use of content, and free expression in the digital environment. (Murray 2023, chapter 10)
6 Week 6: Copyright infringement in the digital environment This week, the class will discuss copyright issues arising from copying and distributing information on the Internet. It begins by discussing how the Internet has challenged the application and development of copyright law. Then, the class will analyse EU legislation and cases of copyright infringement in the online environment. (Murray 2023, chapters 11 and 12)
7 Week 7: Brand identities, search engines, and secondary markets This week describes the role of trademarks in the creation of brand portfolios online. More specifically, it examines brand identities, search engines, and secondary markets and their operation in the information society. It also considers jurisdiction and online trade mark disputes and the growing influence of developments in web browser functionality on consumer behaviour. (Murray 2023, chapter 14)
8 Week 8: Electronic contracts This week discussed contracts in electronic commerce and their implications for traditional contract law. It first looks at the rules for the formation of informal electronic contracts and the regulation of offer and acceptance, focusing on Articles 9–11 of the European Union’s Electronic Commerce Directive. A focus will be paid to the evolving laws on electronic signatures, the role of qualified trust service providers and how electronic signatures are formalised. In the end, a discussion will be on the evolving area of smart contracts. (Murray 2023, chapter 16)
9 Week 9: Mid-term Exam
10 Week 10: Payments, cryptocurrency, and crypto assets This week focuses on payments, cryptocurrency, and crypto assets. It provides an overview of token payments before looking at alternative electronic payment systems including debt substitution, payment by credit cards, and fund transfer. It will look at the EU legislation and current situations. Particularly, the lesson will discuss the development of cryptocurrencies including Bitcoin and how blockchain is used to establish trust in cryptocurrency transactions before analysing the current legal position of cryptocurrencies. 11 Week 11: Consumer protection in digital environment This week examines how consumers are protected when they go online. It analyses the Consumer Rights Directive to distance agreements (including online agreements) and examines the consumer rights to receive information and to cancel contracts agreed at a distance. (Murray 2023, chapter 17) The chapter continues with a discussion of the regulation of unsolicited commercial communications or spam, including the Directive on Privacy and Electronic Communications, GDPR, and the proposed ePrivacy Regulation. It also accounts for changes in the legal framework caused by Brexit.
12 Week 12: Crime and law enforcement in the information society This week focuses on cybercrimes, cyber-attacks such as denial of service attacks, and law enforcement in the information society. It looks at advance-fee fraud, internationally known as ‘419 Fraud’ with reference to Nigeria; as well as the ‘Russian Scam’ that targets the users of online dating sites. The Council of Europe Convention on Cybercrime to harmonize international cybercrime laws will be analysed and several case studies will be discussed. (Murray 2023, chapter 21)
13 Week 13: Data protection: the legal framework, rights and obligations This week focuses on data protection, digitization of data, its implications for personal privacy, and the regulation of data industries. It reviews GDPR and highlights the key concepts of data controllers, data processors, and data subjects, and discusses the rights of data subjects under GDPR (and UK GDPR) and the role of the state in supervising data controllers. (Murray 2023, chapters 22 and 23)
14 Week 14: Tomorrow Courts and Lawyers This week discusses new opportunities for lawyers, new ways of helping clients and the community in the digital environment. During the class, several issues on the digitalisation of courts and legal professionals will be discussed. Moreover, the lesson will highlight the obligation for tomorrow's lawyers to embrace technology. (Susskind 2023, chapters 16-17)
