Course Description: The course will explore the historical development of the right to education as a fundamental human right, as enshrined in the international legal framework, beginning with the Universal Declaration of Human Rights, the Covenant on Civil and Political Rights, and notably the UN Covenant on Economic, Social and Cultural Rights. We will delve into key international instruments that influence the right to education, including the Convention against Discrimination in Education and the 1989 UN Convention on the Rights of the Child. Additionally, we will examine regional conventions, with a focus on those adopted by the Council of Europe and the European Union. By studying these international instruments, students will gain insights into the global scope of the right to education and its implementation at the national level, particularly concerning the entitlements of individuals who have the right to claim its realization. The course will also analyze the evolution of the right to education within Albanian legislation, from its historical context to its characteristics across different historical periods. Topics covered will include the entitlement of individuals to education, the responsibilities of the state, and the various elements crucial for the realization of this right. Furthermore, we will explore the interconnectedness of the right to education with other human rights and its implications for vulnerable groups, both internationally and within Albania. The course will examine the right to education in both pre-university and higher education settings. Additionally, we will discuss related topics such as the role of teachers in ensuring access to education and the intersection of this right with contemporary issues like discrimination and digitalization. The cases of the European Court of Human Rights and national ones will make the implementation and understanding of the right to education very concrete.
Course Objectives: The objective of the course is to give the students a complete overview of the right to education and education legislation with special reference to the Albanian legal framework. The students will acquire knowledge about: International human rights standards on the right to education; The international legal framework on the protection of the right to education; The national legal framework on the protection and the right to education. The students will gain skills in: Identifying obligations of states and recognizing violations of the right to education; Monitoring the right to education through international, regional, and national mechanisms: the use of right-based indicators and budget analysis; Developing strategies for advocating the right to education.
BASIC CONCEPTS OF THE COURSE
1 The right to education is a fundamental human right recognized by the United Nations and many national constitutions and legal systems around the world. It encompasses the belief that everyone, regardless of gender, ethnicity, socioeconomic status, or other characteristics, should have access to education on an equal basis.
2 A teacher is an individual who facilitates learning by imparting knowledge, skills, and values to students or learners. Teachers play a crucial role in the educational process by designing and delivering instructional materials, assessing student progress, providing feedback, and creating a supportive learning environment. They may work in various educational settings, including schools, colleges, universities, or other formal and informal learning environments.
3 Inclusive education is an approach to schooling and education that aims to ensure all students, regardless of their background, abilities, or disabilities, are provided with meaningful opportunities to learn and participate in all aspects of school life. It promotes diversity, equity, and respect for the rights of all individuals, and it seeks to remove barriers to learning and create supportive environments where every student feels valued and included.
4 A student is a person who is engaged in learning, typically within a formal educational setting such as a school, college, university, or other learning institution. Students can range from young children in primary school to adults pursuing higher education or professional development.
5 Basic education also known as primary education or elementary education in some contexts, refers to the foundational level of education that children typically receive during their early years of schooling. It is considered essential for laying the groundwork for further learning and development throughout a person's life.
6 Higher education refers to tertiary education beyond the secondary level, typically provided by universities, colleges, and other institutions that offer academic degrees and advanced learning opportunities. It encompasses a wide range of programs and courses designed to provide students with specialized knowledge, skills, and qualifications for various career paths and professional fields.
7 Educational freedom, also known as academic freedom or educational autonomy, refers to the principle that educational institutions, educators, students, and parents should have the freedom to pursue and participate in education without undue interference or restriction from external authorities.
8 Parental Rights: The freedom of parents to make educational choices and decisions on behalf of their children, including the ability to choose the type of education (e.g., public, private, homeschooling) that best aligns with their values, beliefs, and preferences.
9 Curricular Freedom: The freedom of educational institutions and educators to design and implement curricula that reflect their educational philosophies, values, and goals. This includes the ability to select course content, teaching methods, and instructional materials that are relevant and appropriate for their students.
