Course Description: Kjo lëndë studion mënyrën se si është e rregulluar e drejta e konkurrencës në kuadër të Bashkimit Evropian. Në të trajtohet ana rregullatore e së drejtës së konkurrencës sipas parashkimive të bëra në aktet e Bashkimit Evropian, duke u ndalur në normat konkrete që analizojnë në detaje pozitën dominuese në tregje, marrëveshjet e ndaluara, përqëndrimet e shoqërivë, mënyrat e bashkëpunimit ndërshtetëror dhe rajonal, etj. Shihet mënyra se si e drejta e konkurrencës vepron në tregjet më kryesore, si ai i telekomunikacionit, komunikimeve elektronike, energjise, ujrave, etj. Pjesë e fokusit të studimit janë edhe raporti i së drejtës së konkurrencës me të drejtat e konsumatoirt apo pronësinë intelektuale. Gjithashtu, merret në studim aspekti institucional dhe procedural që mundëson aplikimin e së drejtës së konkurrencës në kuadër të Bashkimit Evropian. Lenda ndërthur teoritë e dhëna me studimin e rasteve më të spikatura që kanë implikuar këtë të drejtë.
Course Objectives: Ky kurs synon, ndër të tjera: 1. Të pajisë studentin me një informacion të thelluar mbi të drejtën e konkurrencës dhe kuadrin rregullator të saj në kontekstin e Bashkimit Evropian 2. Të njohë studentin me aktet normative të Bashkimit Evropian dhe dispozitat përkatëse të tyre, të cilat përbëjnë bazen ligjore dhe kuadrin rregullator të së drejtës së konkurrencës 3. Të japë një informacion të plotë mbi aspektin procedural dhe institucional që ekziston në kuadër të Bashkimit Evropian në fushën e konkurrencës 4. Të aftësojë studentin në kuptimin e detyrimeve që çdo shteti evropian, anëtar ose jo në BE, i burojnë nga aktet e Bashkimit Evropian në fushën e konkurrencës 5. Të ndihmojë studentin të vlerësojë rëndësinë që respektimi ikonkurrencës së ndershme ka në mirëfunksionimin e tregjeve më të rëndësishme Evropiane 6. Të ndërthurë anën teorike në kuadër të së drejtës së konkurrencës, me mënyrën si ajo gjen aplikim në praktikë, duke u ndalur në studimin e rasteve më tipike ku ka gjetur implikim kjo e drejtë.

Week Topics
1 Introduction to Competition Law: This week provides an introduction of the course and materials discussed. It introduces some relevant concepts of microeconomics. The model of perfect competition the monopoly and the oligopoly will be discussed. In the end, the course discusses the possible objectives of competition law, and particularly considers the objectives of EU competition law. 2 The Competition Law and Institutions of the European Union: This week provides a short introduction of the history and functions of the EU competition rules. Also, institutional design and their competences in the EU competition context is discussed. It then describes the competition provisions themselves and outlines the way in which the rules are applied and enforced making reference to Regulation 1/2003. Moreover, the notion of public enforcement and private enforcement will be discussed by making reference to the Treaty Provisions, secondary Sources and settled case law. 3 Market Power, Market Definition, and Barriers to Entry: Market power is a central concept in EU competition law. This week considers what is meant by market power and how it is assessed in EU law using market definition and barriers to entry analysis. It discusses how markets are defined in EU law by looking at demand substitution, supply substitution, and potential competition. During this week, we will examine several EUCJ cases, Commission decisions and draft new Commission Notice on the definition of the relevant market to replace the 1997 Notice. 4 Article 101 TFEU- The Elements and substantive appraisal: This week discusses Article 101 which prohibits agreements, decisions, and concerted practices which restrict competition and affect trade between Member States. It explains the terms employed in Article 101(1) and how they are interpreted and applied. Then, the relationship between Article 101 (1) and 101 (3) is examined. 5 Article 102 TFEU-Dominant Position and conduct that constitutes an abuse of dominant position This week discusses the role of Article 102 and the controversy attending its application, and introduces the elements which must be established before the prohibition applies. After explaining the scheme of Article 102, it will be discussed the difficult concept of what constitutes an ‘abuse’ of a dominant position for the purposes of Article 102. 6 Competition and the State (Article 106 TFEU): This week examines applicability of competition law to the actions of the State when it intervenes in the market through undertakings which it controls or owns or which it places in a privileged position. During the presentation, the scheme of Article 106 will be discussed and the question of the direct effect of Article 106(1) and (2). 7 Horizontal Agreements—Cartels and Collusion: This week examines how EU competition law applies both to undertakings operating cartels and to undertakings that tacitly coordinate their behaviour on a market. Also, the week will deal with cartels and other agreements akin to cartels, or which may facilitate explicit or tacit collusion on a market. 9 Horizontal Cooperation Agreements: In this week, the EU competition policy towards horizontal cooperation agreements will be discussed. It will be covered joint ventures; the contents of the 2022 Draft Guidelines; the general approach to horizontal cooperation agreements in the Guidelines; research and development agreements; production agreements; purchasing agreements; commercialisation agreements; standardisation agreements; and sustainability agreements. 10 Vertical Agreements: This week discusses EU competition policy towards vertical agreements. 11 Public Enforcement of Article 101 and Article 102 by the Commission and the National Competition Authorities: This week discusses the public enforcement regime for the application of Articles 101 and 102 under Regulation 1/2003 and ECN+ Directive. In this week, the following elements are examined: the complaints procedure; the powers of the Commission; the decisions which the Commission may take, including decisions imposing fines and commitments decisions; judicial review by the EU Courts; the European Competition Network (ECN) and enforcement by national competition authorities and the possibility of sanctions against individuals. 12 Private Enforcement of Articles 101 and 102: This week focuses on the private civil enforcement of EU antitrust rules through claims made by private litigants in the national courts and tribunals of the individual Member States. A short history of the evolution of the private enforcement mechanism by looking to CJEU settled cases and Commission soft laws will be provided. Then, the 2014 Damages Directive and its impact will be discussed. 13 Mergers: This week discusses the regime for controlling mergers which have an ‘EU dimension’ under the European Union Merger Regulation (EUMR). The following elements will be examined: the purposes of merger control; the history of the EUMR; the scheme of the EUMR and the concept of the ‘one-stop shop’; jurisdiction under the EUMR, including the definition of a ‘concentration’ and what amounts to an ‘EU dimension’; procedure, including Phase I and Phase II proceedings; the substantive appraisal of horizontal, and non-horizontal, mergers under the EUMR and the test of significantly impeding effective competition (SIEC); EUMR statistics; appeals; and international issues. 14 EU Competition Law and Policy in the Digital Economy: This chapter considers the application of the EU competition rules specifically within the digital economy. It considers the need for special rules to regulate Big Tech Behaviour. In particular, the DMA will be discussed focusing more on the obligations imposed and the enforcement system.
